Abstract

The testimony without damage is a practice of children’s inquiry supposedly victims of sexual abuse, that is being introduced in the Judiciary, where the inquiry is accomplished by a psychologist. I question, firstly, the truth of the speech produced by the child in a testimony, trying to discuss what it is called, in psychoanalysis, of truth report – vivencial starting from the traumatic of the event and its psychic consequences. Secondly, I question about the certainty of the proof and the ways of listening and intervention from an ethical perspective of doing of the psychologist.
