El texto trata de la desobediencia civil como derecho. De hecho, Habermas entiende la desobediencia civil como uno de los derechos originarios del soberano. El texto reconstruye la objeción de Raz de que la desobediencia civil no es un derecho y toma en serio esta objeción para escudriñar algunas de las consecuencias que tal formulación podría tener para la teoría de la desobediencia civil de Habermas. Se argumenta que la versión de la desobediencia civil defendida por Habermas es capaz de ofrecer una respuesta a la objeción de Raz.
